
What is parental leave?
“Leave granted to fathers and mothers during a period after the termination of maternity leave to enable parents in employment to look after their newborn child for a certain time, whilst giving them some degree of security in respect of employment, social security and remuneration…Parental leave is also granted to adoptive parents”
Parental Leave Rights in Albania
In the latest changes of Labor Code in Albania ,Article 132/1 provides the parental leave rights .
This means that parents will be able to benefit from an ’ unpaid parental leave of not less than 4 months where their children are aged 6 or under.The parental right is individual and it is not transferable except of the cases of the death of one of parents.The parental leave can be given in parts but not less than one week per year.Its duration is provided in written between employer and employee.In cases of adoption , the parental leave can be given within 6 years from the adoption date of the child , however not later than when the child reaches the age of 12 years old.
Also as per article 27 paragraph 7 of Social Security Law the insured father or adoptive male parent is entitled for the right of maternity leave after the period of 63 days after the birth in case the mother does not meet the insurance requirements of the law or does not want to exercise such right .
For employers , key action is to review and update existing workplace policies and make sure that employees are well informed about such right and provide the necessary instructions for allowing them to apply for it.
For employees, make sure to follow the legal requirements of article 132/1 paragraph 3 as it follows:Notification period of 2 weeks in advance (which means that employee should notify in written the employer at least two weeks in advance). Please note that employer reserves the right to postpone the starting date of parental leave up to six months for reasons provided in the law.In such case employer should inform in written the employee within two weeks upon the reasons of such postponement .
